Privacy Policy

1. Purpose

This privacy policy (hereinafter the “Policy”) sets out the guidelines relating to the collection, use, communication, retention, and destruction of documents containing personal information held by Wawa Productions (hereinafter “Wawa Productions”) in the course of its activities, in accordance with the Act Respecting the Protection of Personal Information in the Private Sector (CQLR c. P-39.1) and the Act to Modernize Legislative Provisions Respecting the Protection of Personal Information (2021, c. 25) (collectively hereinafter the “Act”).

2. Scope

This Policy applies to Wawa Productions, including, but not limited to, its employees, board members, interns, volunteers, and any person providing services on behalf of Wawa Productions, particularly those who collect, use, communicate, retain, or destroy documents containing personal information. It covers all personal information collected, used, and retained by Wawa Productions, regardless of its form.

3. Definitions

  • Personal Information: Any information relating to an individual that allows for their identification, directly or indirectly, such as identity information (name, address, date of birth, etc.) and contact information (email address, phone number, etc.).
  • Privacy Incident: Unauthorized access, use or disclosure, loss, or any other violation of personal data.
  • Privacy Officer: The person designated by Wawa Productions to act as the privacy officer under the Act.

4. Roles and Responsibilities

4.1 Wawa Productions

Wawa Productions protects the confidentiality of information by implementing effective information management protocols, including providing advice, training, and instructions to its employees on issues such as the collection, use, storage, modification, access, disclosure, and authorized destruction of personal information.

4.2 Privacy Officer

The Privacy Officer of Wawa Productions can be contacted at privacy@wawaproductions.ca. The Privacy Officer ensures compliance with and implementation of the Act within Wawa Productions, participates in developing policies and practices regarding the protection of personal information, responds to requests and complaints related to personal information, and coordinates the management of privacy incidents.

4.3 Employees, Interns, Volunteers, Consultants, and Service Providers

An employee, intern, volunteer, consultant, or service provider of Wawa Productions may only access personal information to the extent necessary to perform their duties. They ensure the protection of personal information by complying with the Policy.

5. Consent

Wawa Productions collects, uses, and discloses personal information only with the explicit, voluntary, informed, and specific consent of the individual. Individuals may withdraw their consent in writing at any time. However, if this data collection is essential for Wawa Productions to fulfill its contractual obligations, it may hinder Wawa Productions’ ability to provide services.

6. Collection of Personal Information

Wawa Productions only collects personal information necessary for its activities. Generally, Wawa Productions collects personal information directly from the individual concerned and with their consent, except as otherwise provided by law.

7. Use and Disclosure of Personal Information

Wawa Productions is committed to using and disclosing personal information only for the purposes for which it was collected and as authorized by law. Access to personal information will be limited to employees who need to know it to perform their duties. Wawa Productions may disclose personal information to third parties if it is essential for the execution of a mandate or contractual service.

8. Disclosure Outside Quebec

Before disclosing personal information outside Quebec, Wawa Productions will consider factors such as the sensitivity of the information, the intended use, and the protective measures available in the external jurisdiction. Wawa Productions will only disclose personal information outside Quebec if the protective measures are deemed sufficient.

9. Retention and Destruction of Personal Data

Wawa Productions retains personal information for a period provided by law. When the purposes for which personal information was collected or used have been fulfilled, it will be securely destroyed.

10. Privacy Impact Assessments

Wawa Productions will conduct privacy impact assessments for new and existing projects involving the collection, use, or disclosure of personal information.

11. Cookie Management

Wawa Productions uses cookie management platforms (CMP) to manage cookies on its website. Users are provided with clear information on how their data will be used before obtaining their explicit consent. Users can accept certain uses of their data and refuse others.

12. Privacy Incident

In the event of a privacy incident, Wawa Productions will take reasonable steps to reduce the risk of harm and prevent future similar incidents. If the incident poses a risk of serious harm, Wawa Productions will notify the Commission d’accès à l’information and the individual concerned.

13. Complaint Management

Anyone concerned about the protection of their personal data or the application of this Policy may file a written complaint with the Privacy Officer of Wawa Productions.

14. Effective Date

This Policy is effective as of July 10, 2024, and may be amended from time to time to comply with the law. Any amended policy will be made available.
